UNDERSTANDING YOUR RIGHTS
What Is an Emotional Support Animal Letter?
An ESA letter is a formal document written by a licensed mental health professional that certifies your emotional support animal is a medically necessary part of your treatment for a diagnosed mental health condition. Under the Fair Housing Act (FHA), this letter entitles you to keep your ESA in housing that would otherwise prohibit pets — without paying pet deposits or fees.
🏠
Fair Housing Act (FHA)
The Fair Housing Act requires landlords to make reasonable accommodations for tenants with disabilities — including allowing emotional support animals even in no-pet buildings, without charging pet deposits or fees. A valid ESA letter from a licensed provider is required to exercise this federal right.
🐾
No Pet Fees or Deposits
With a valid ESA letter, landlords cannot charge pet fees, pet deposits, or additional rent for your emotional support animal. Your animal is recognized as a medical accommodation — not a pet — under federal housing law. This applies to apartments, condominiums, co-ops, and most housing types.
⚠️
Why Online Letters Fail
Online ESA letter mills — sites that issue letters in minutes without a real clinical relationship — are increasingly rejected by landlords and challenged in court. HUD guidelines require letters from a licensed mental health professional with genuine knowledge of your condition. Our letters are clinically grounded and legally defensible.
HOW IT WORKS
From Consultation to Letter — In Three Simple Steps
01
Clinical Consultation
You meet with one of our board-certified psychiatrists — in person at our North Miami clinic or via secure telehealth from anywhere in Florida. We conduct a genuine clinical evaluation of your mental health condition and assess whether an ESA is therapeutically appropriate for your specific situation.
02
Clinical Determination
If our psychiatrist determines that an ESA is clinically indicated as part of your mental health treatment — based on your diagnosis and individual circumstances — they will document this recommendation in your medical record. This is what makes our letters legally valid: a real clinical decision, not an automated process.
03
Letter Issued
Your ESA letter is issued on ACC official letterhead, signed by your psychiatrist, and includes all required elements — provider license number, your diagnosis category, the clinical basis for the ESA recommendation, and your psychiatrist’s contact information. Delivered same day or next business day. Valid for 12 months.
COMMON QUESTIONS
Everything You Need to Know
What mental health conditions qualify for an ESA letter?
Qualifying conditions generally include depression, anxiety disorders, PTSD, panic disorder, bipolar disorder, OCD, phobias, and ADHD. The key requirement is that you have a genuine, diagnosed mental health disability and that an emotional support animal is determined to provide meaningful therapeutic benefit. Our psychiatrist makes this determination on a case-by-case clinical basis.
How is your ESA letter different from an online one?
Our ESA letters are written by board-certified psychiatrists following a genuine clinical evaluation — not generated by an algorithm after a three-question online form. Our psychiatrists are licensed in Florida with verifiable credentials, and our letters include all HUD-required elements. Landlords are increasingly rejecting online-mill letters. Ours hold up legally because they are clinically real.
Can I get my ESA letter via telehealth?
Yes. We offer ESA consultations via secure, HIPAA-compliant telehealth for patients anywhere in Florida. A valid telehealth psychiatric evaluation is legally sufficient to support an ESA letter under HUD guidelines. After your video consultation, your letter is issued and delivered digitally same day or next business day.
How long does an ESA letter last?
ESA letters from Assertive Comprehensive Care are valid for 12 months from the date of issue. Annual renewal requires a follow-up consultation to confirm the ESA remains clinically appropriate. Many landlords require annual renewal, which is why maintaining an active care relationship matters.
What does a valid ESA letter need to include?
Under HUD guidelines, a valid ESA letter must include: the provider’s license type and number, the state in which they are licensed, the type of mental health condition, a statement that the ESA is prescribed as part of treatment, and the provider’s signature and contact information. Our letters include all required elements on official ACC letterhead.
Do airlines have to accept ESA letters?
No. As of 2021, the Department of Transportation no longer requires airlines to accommodate emotional support animals — only trained service animals. ESA letters now apply primarily to housing situations under the Fair Housing Act. If you need to travel with your animal, you would need to look into training your animal as a service animal, which is a separate process.
